Introduction
Welcome to Southern Summits Trail Running & Hiking Tours. These terms and conditions outline the rules and regulations for the use of our website and the provision of our guided trail running and hiking tours. By accessing this website and booking our tours, you agree to comply with and be bound by these terms and conditions.
Booking and Payments
- Booking Process:
- All bookings must be made through our website or authorised agents.
- A booking is confirmed only when you receive a confirmation email or message confirming details of the tour, including an invoice.
- Payment Terms:
- Full payment is required at the time of booking unless otherwise specified.
- Cancellation and Refunds:
- Cancellations made more than 60 days prior to the tour date will receive a full refund minus any out of pocket expenses that Southern Summits Trail Tours has incurred. Such expenses shall be documented and sent to guests in the event of cancellation requests.
- Cancellations made between 30-60 days prior to the tour date will receive a 50% refund minus any out of pocket expenses that Southern Summits Trail Tours has incurred. Such expenses shall be documented and sent to guests in the event of cancellation requests.
- Cancellations made less than 30 days prior to the tour date are non-refundable.
- No refunds will be given for no-shows or for cancellations after the tour has commenced.
- Rescheduling:
- Rescheduling requests made more than 30 days prior to the tour date are allowed subject to availability and may incur a rescheduling fee.
- Rescheduling requests made less than 30 days prior to the tour date will be treated as cancellations and will incur cancellation fees.
Participation Requirements
- Fitness and Health:
- Participants must complete the fitness assessment form prior to the tour.
- You certify that you are physically fit and have no medical condition that would make participation in the tour unsafe.
- Minimum Age:
- Participants must be at least 18 years old to join our tours without a guardian.
- Minors (under 18) must be accompanied by a parent or guardian.
- Equipment and Gear:
- Participants are responsible for bringing appropriate gear as specified in the tour details.
- We reserve the right to refuse participation to anyone without proper equipment.
Indemnity and Liability
- Assumption of Risk:
- By participating in our tours, you acknowledge that outdoor activities involve inherent risks, including but not limited to, physical exertion, weather conditions, and wildlife encounters.
- Indemnification:
- You agree to indemnify, defend, and hold harmless Southern Summits Trail Running & Hiking Tours Pty Ltd., its affiliates, and their respective officers, directors, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorney’s fees, arising out of or in any way connected with your participation in the tour.
- Limitation of Liability:
- To the maximum extent permitted by applicable law, Southern Summits Trail Running & Hiking Tours Pty Ltd. shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to, loss of enjoyment, loss of revenue, or emotional distress arising out of or in connection with your participation in our tours.
Changes and Amendments
- Tour Modifications:
- Southern Summits Trail Running & Hiking Tours Pty Ltd. reserves the right to modify, reschedule, or cancel tours due to weather conditions, safety concerns, or other unforeseen circumstances.
- We reserve the right to cancel, alter or modify any trip without prior notice for any reason, including but not limited to for the safety, comfort and / or well-being of trip participants and for circumstances of Force Major, i.e. circumstances beyond our control which prevent us from providing the trip as planned. This includes the right to replace or substitute guides and accommodation on the trip, modify the order in which places are visited, and make other changes in the itinerary.
- If we are forced to significantly alter or cancel your trip due to Force Majeure, which is rare, we will let you know as soon as possible. In these circumstances, you can choose one of the following options:
- Accept our offer of a comparable replacement trip, offered at our sole discretion and subject to availability, or
- Receive a refund of all monies paid less any non-refundable deposits paid to third party suppliers.
- When accepting an offer for a replacement trip:
- If the cost is lower than the price of your original trip, you will receive a refund for the difference in cost, or
- If the cost of the replacement trip is higher than your original trip, you owe nothing. We will work with our suppliers to try and obtain any non-refundable deposits so that we can give you a full refund. We cannot guarantee such a result, though.
- Amendments to Terms:
- We reserve the right to amend these terms and conditions at any time without prior notice. Any changes will be posted on our website and will become effective immediately upon posting.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of South Africa, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of South Africa.
